Since the judgment of the Inter-American Court of Human Rights in the “case of Dominican and Haitian people with the Dominican Republic” it has been discussed with greater intensity if the Inter-American Court should begin to use the doctrine of the margin of appreciation in the inter-American space. At this address writers write about the authority and legitimacy of the Inter-American Court - and international courts in general - to resolve difficult cases and condemn states for violation of human rights (...) contemplated in the American Convention on Human Rights or in the respective international treaty. Other authors advocate the incorporation of the doctrine of the margin of appreciation by the Inter-American Court as a way to better articulate the inter-American political community. After reviewing the doctrinal positions in this regard, I will argue that the use of the doctrine of the margin of appreciation in cases of multicultural type may imply the invisibility of existing tensions within national communities, where many times, the culture and practices of The minorities indicated are belittled by the majority or hegemonic culture. This is the case of the indigenous and migrant population in the American context, so the use of the margin of appreciation doctrine in this type of cases may imply that international courts validate the violation of the human rights of minorities within of the States. In that sense, the work will argue that a limited application of the national margin of appreciation in multicultural cases of vulnerable groups, allowing regional human rights courts to protect ethnic, religious and cultural minorities against the established internal discrimination or against the violation of the rights protected in the American Convention of Human Rights. Lo que se pretende, considerando una contaminación cruzada entre lo sensible y lo inteligible, es rastrear otra verdad para aquello que ha sido considerado, especialmente por el (...) platonismo en sus diversas configuraciones, como lo inesencial frente al andamiaje trascendental de las ideas. En consecuencia, y a partir de un acercamiento pre-liminar, lo que se busca es permitir que los datos sensibles resuenen al interior de lo inteligible, y que lo hagan, además, de un modo no dialectizable. Rastrear en la escritura de Jacques Derrida la existencia de un pensamiento otro de la materialidad no es tarea sencilla. Sin embargo, es la tarea que se propone delinear, al menos en sus coordenadas generales, el presente artículo. Ello, inicialmente, implicaría seguir una serie de elementos propios de la tradición presocrática que estarían inscritos a modo de huellas en la escritura deconstructiva. En tal sentido, nociones como las de átomo, vacío y movimiento serán consideradas, en diversos momentos del presente texto, (...) en el marco de una interpretación contemporánea de la divisibilidad y fragmentación de lo existente. A partir de estas consideraciones y su relación con la escritura en el pensamiento de la deconstrucción se sostendrá el carácter cuasi-trascendental de la materia. (shrink)

Dentro del organigrama de la industria musical, las casas discográficas y emisoras radiales generan su dependiente relación por medio de la música grabada. En nuestro país, entre los años 1964-67, los sellos fonográficos nacionales lograron que muchos de sus artistas fueran invitados a las estaciones radiales por los disc-jockeys más famosos para promocionar sus discos. No obstante, se produjeron constantes discusiones y polémicas cuando las radios no difundieron, o bien, silenciaron muchos registros discográficos de intérpretes criollos, puesto que consideraron que (...) las casas disqueras plasmaron mucha música que no merecía ser editada. Las emisoras radiales se defendieron argumentando que, prácticamente,no valía la pena ser dueño de un pequeño sello discográfico, ni invertir en promoción, ni conseguir discos de éxito cuando sus artistas no podían demostrar su talento en directo. En otras palabras, las radios chilenas exigieron calidad integral al artista nacional: hit radial y presentación en vivo. (shrink)

La escuela desde sus concepciones de formación debe asumir una posición clara que considere las perspectivas y los estudios de género tanto para la construcción de los programas, los discursos y las prácticas que se producen y se reproducen en tales espacios. La didáctica de las ciencias sociales es un área fundamental, que permite entregar las herramientas para reflexionar y promover prácticas que contribuyan a la justicia social frente a la violencia contra las mujeres. En el presente escrito, nos enfocamos (...) en algunas reflexiones que ha realizado el profesorado de didáctica de las ciencias sociales, en especial, sobre las ventajas y las limitaciones con que se encuentran al incluir y trabajar con las mujeres y sus problemas. La metodología que se ha utilizado es un estudio colectivo de casos. El estudio da cuenta que existe un compromiso y preocupación por el tratamiento de las problemáticas de las mujeres en las aulas. The literature on autonomous language learning reveals both, scholars’ great enthusiasm for the revolutionary potential of learner autonomy as well as pessimism for its continual depoliticization within higher education. Similar to how ‘learner autonomy’ is still today an unfinished construct that raises considerable confusion among scholars, the critical theory of learner autonomy in the field of language learning remains largely unexplored; and thus, yet to be fully articulated. Building on the relevant literature, this article attempts to provide a coherent and (...) nuanced theoretical framework for the critical practice of learner autonomy in higher education. Results show how the field of language learning is dominated by uncritical and apolitical approaches that render learner autonomy a politically impotent practice. Critical autonomous language learning must be both critically aware—so it can raise students’ awareness of the structural and discursive constraints on their autonomy—and politically active—so it may lead to education reform and social change—, while also aiming at reaching the highest levels of institutional material support and student control possible. Resumen:La filosofía ofrece múltiples ópticas para considerar el curso de la historia de la humanidad, perspectivas que van desde lo epistemológico hasta lo metafísico. Entre aquellas posibilidades interpretativas se encuentra el juego, específicamente la concepción antropológica del ser humano en tanto homo ludens –tema ya trabajado por Holzapfel en una obra previa–. A partir de dicha concepción lúdica del ser humano es posible analizar la dialéctica de los diversos tipos de juegos en el desarrollo histórico. La presente obra constituye una (...) invitación a recorrer el despliegue del homo ludens hasta las repercusiones de su desregulación agonal (juego de competencia) en nuestros días, proponiendo una solución lúdica a la crisis actual. Building upon the insights of scholars attuned to story, narrative, and myth, this article explores the relationship between myth, science, and religion. After clarifying the interplay of the three terms—story, narrative, and myth—and the preference for the term myth, this article will argue that myth can serve as a medium through which religion, neuroscience, and mental well‐being interact. Such an exploration will cover the role of myths in religion, the neurological basis of myth, and the practices of narrative psychology and (...) bibliotherapy. The article will conclude with suggestions for understanding and utilizing the relationship between myth and the scholarly study of the relationship between science and religion. This article ultimately suggests that myth can operate as a methodological aid to the science‐and‐religion field. (shrink)

El presente artículo reflexiona sobre los escenarios de posibilidad que existen en las aulas y en la enseñanza de la historia y las ciencias sociales desde dos perspectivas. Se cuestiona, desde la perspectiva de la investigación de Marolla (2016), el contenido de los discursos del profesorado chileno sobre la inclusión y la enseñanza de la historia. Los discursos se contrastan con investigaciones realizadas sobre el contenido de las fuentes judiciales de la ciudad de Concepción y los roles de las mujeres. (...) Se reflexiona en torno a los espacios y las herramientas que existen desde la didáctica para generar innovaciones y transformaciones a las desigualdades que existen por razones de género. El contenido de los discursos ha sido analizado bajo una metodología cualitativa a través de un estudio de casos. Los archivos judiciales han sido analizados bajo una metodología cualitativa descriptiva. Lo fundamental es el poder visualizar que existen espacios y caminos para generar innovaciones didácticas. This article is a response to Josh Reeves's recent book Against Methodology in Science and Religion: Recent Debates on Rationality and Theology that welcomes Reeves's proposal for an anti‐essentialist future for the field of science‐and‐religion, particularly because it has the potential to move the field beyond current, well‐worn methods: the dominance of Christian theology and doctrine, the importance of credibility strategies, and the dependence upon philosophical discourses. Reeves’ proposal has the potential to open the science‐and‐religion field to other topics, problems, (...) and methods, such as studying lived science‐and‐religion. One way of doing this is to study popular culture and its artifacts such as literature, which portrays a co‐mingling of religion and science at the level of day‐to‐day experiences and practices of characters. For at the level of lived experience, religion and science are not well‐defined disciplines neatly compartmentalized into separate academic departments. (shrink)

Evaluating the advantages and disadvantages of treatment options often presents a more significant challenge for patients with lower levels of health literacy. Specifically, the article will examine the potential of shared decision-making to bridge gaps in knowledge, increase patient adherence to treatment, and improve health outcomes in low health literacy patient populations. What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a "form" that, when applied to different legal themes, would add a "material content" to the three-dimensional theory. We can point out, as a study plan, the distinction between "three" perspectives: Those of the legal norm, of the legal order, and the legal relationship. This essay assesses Quentin Meillassoux’s numerological approach to Mallarmé’s problematic but formally innovative poem “Un Coup de dés,” using a semiotic methodology to reveal the deficiencies of that approach from the viewpoint of literary theory. Section 1 describes my expanded version of Michael Riffaterre’s semiotic theory of the structure of modern poetry. Poems are generated by two underlying propositions, each of which governs the structure of a set of symbolic images on the textual surface. These “matricial” propositions are linked by (...) a syntagmatic relation. The primary text functions as subject-sign of the Peircean semiotic triad; its object-sign is an intertextual model. The interpretant of these two textual signs is assembled by the reader and has a sociolectic counterpart – or context – which has similar lexical content but contrasting internal structure. This contrast may produce a change in the preconceptions of the reader. Section 2 examines Meillassoux’s approach to Mallarmé’s poem, which is preoccupied with a “number” supposedly encrypted in the text. This is not convincingly related to the propositional structure of the poem. In Section 3, the text is interpreted using a semiotics-based methodology. The poem is generated by two matrices: one concerning the “Master” versus the storm, and the second concerning the power of Chance. The relation linking the matrices is clarified. This analysis is compared with that of Meillassoux throughout. Section 4 resumes the differences between Meillassoux’s concentration on the “number” and the “siren,” and my analysis which centres on the relation between the Master (symbolising traditional poets and their preferred metre) and the Constellation (symbolising the wide range of new future poetic metres and formats). Meillassoux’s approach turns out to be unconvincing. (shrink)

La denotación de los nombres propios es un problema tradicional de la Filosofía que aún es discutido en nuestros días. La tesis de este ensayo es que, lejos de ser una problemática superada, el debate sigue muy vivo y se siguen generando constantes aportaciones que contribuyen a enriquecer esta discusión en la actualidad. El objetivo que aquí se propone es mostrar que los argumentos tradicionales están motivando nuevas propuestas que mantienen la actualidad del debate, como las de Robert Stalnaker y (...) Jason Stanley. Para este propósito, se emplea el método hermenéutico-crítico sobre la bibliografía consultada. Concluimos reivindicando la actualidad del tema en Filosofía. (shrink)

POLITICS is a system of computer programs which simulates humans in comprehending and responding to world events from a given political or ideological perspective. The primary theoretical motivations were: (1) the implemention of a functional system which applies the knowledge structures of Schank and Abelson (1977) to the domain of simulating political belief systems; (2) the development of a tentative theory of intentional goal conflicts and counterplanning. Secondary goals of the POLITICS project include developing a representation for belief systems, investigating (...) cognitive processes such as goal‐directed inferencing, and the integration of several types of knowledge representations into a functional system. Para ello sugiere la importancia de generar un lenguaje apropiado, que entre otras cosas debiera permitirnos comprender la unidad en la diversidad. Agrega que requerimos una tercera expansión de la conciencia que nos puede llevar hacia la planetización de la conciencia humana. ¿Cómo se ha constituido el sujeto científico? ¿De qué manera se ha levantado el edificio de la razón? Este libro es una aportación a una línea de estudios rigurosa. La filosofía de la ciencia ha tenido en los últimos decenios un empuje académico notable y, a la reciente bibliografía con que cuenta esta renovada disciplina, deberá añadirse este brillante y hondo ensayo, abordado "desde el movimiento de las ideas mismas". Este nuevo desarrollo exigía una capacidad de abstracción considerable: desde Heráclito (...) hasta Heisenberg, Popper, Lakatos, para despejar la "figura ficticia" del sujeto de la ciencia. Jaime Labastida ha ordenado en varias líneas paralelas ese proceso de constitución del sujeto científico moderno: la línea de la filosofía, la línea de la física, la de las ciencias naturales, la de la economía política. La conclusión subraya con gran solidez cómo se edifica la razón, condición necesaria para hacer ciencia rigurosa. (shrink)

The role of academic satisfaction on persistence and successful academic behavior has been the focus of research for decades. Nevertheless, driven by positive educational psychology, subjective well-being has been highlighted as another central feature in the academic path of students. Studies aimed at identifying the variables that contribute to explain different aspects of academic performance have been widely investigated, although studies aimed at identifying the determinants of subjective well-being are still limited. The present paper examined the contribution of AS judgments (...) on subjective well-being. To this end, it was hypothesized that SWB levels depend on the balance between positive/negative emotions and life satisfaction judgments. Furthermore, it was stipulated that AS has an indirect contribution on SWB, through life satisfaction, whereas the balance of emotions influences both AS judgments and life satisfaction. Using an analysis strategy based on structural equation modeling, the results indicated that the model fitted satisfactorily, explaining 32% of the variance of SWB. Particularly, it was observed that AS judgments contributed to life satisfaction judgments. Although no direct contribution of AS on SWB was reported, a total contribution partially mediated by life satisfaction judgments was revealed. These findings support the importance of academic satisfaction judgments, not only because of their importance in academic terms, but also because of their impact on university students’ subjective well-being and health. In Spain before the 1990s there was no clear and explicit comprehensive training for future engineers with regard to social responsibility and social commitment. Following the Spanish university curricular reform, which began in the early 1990s, a number of optional subjects became available to students, concerning science, technology and society (STS), international cooperation, the environment and sustainability. The latest redefinition of the Spanish curriculum in line with the Bologna agreements has reduced the number of non-obligatory subjects, but could lead to (...) improving preparation for social responsibility due to the requirement that the design of curricula and the assessment of students should be based on competencies, some of which include human values and attitudes. In a recent opinion paper, it was argued that individuals with multiple retractions or a record of academic misconduct should not serve as editors, including as editors-in-chief, on the editorial boards of scholarly or academic journals. As a first step towards appreciating how such a policy could be applied in practice, the presence of 30 individuals listed on the Retraction Watch Leaderboard on editorial boards was screened. Six cases are highlighted to gain an appreciation of the potential reputational risks that (...) journals and publishers might incur by including individuals with a tainted academic record on editorial boards. Given the reputational, legal and other risks associated with this type of assessment and decision, more formal positioning and guidance are needed by global ethics policy-related bodies such as COPE, the ICMJE, and the CSE, even more so in journals that claim to follow these organizations’ ethical guidelines. We define the notion of Souslin forcing, and we prove that some properties are preserved under iteration. We define a weaker form of Martin's axiom, namely MA(Γ + ℵ 0 ), and using the results on Souslin forcing we show that MA(Γ + ℵ 0 ) is consistent with the existence of a Souslin tree and with the splitting number s = ℵ 1 . We prove that MA(Γ + ℵ 0 ) proves the additivity of measure. Also we introduce (...) the notion of proper Souslin forcing, and we prove that this property is preserved under countable support iterated forcing. We use these results to show that ZFC + there is an inaccessible cardinal is equiconsistent with ZFC + the Borel conjecture + Σ 1 2 -measurability. (shrink)
